Minnesota Volleyball Ventures, LLC (also referred to herein as “MVV,” “we,” “us,” and “our”) collects personal information from you and about you. ·       Information You Provide or Make Available to Us. We may temporarily access information from your contact list if you ask us to send a text message or email to one of your contacts to, for example, transfer tickets to that contact. We may also temporarily access your camera and/or collect an image or images from your device if you provide access to us so you can, for example, create a user profile. We may also collect personal information you post in a public space on our website. We may collect personal information that you submit when you contact our customer service team or your account representative. We may also collect personal information when you enter a promotion or complete a survey.

·       Web and Network Analytic Information. We may collect web and network analytic information about your use of our website and/or network.  This may include a unique personal identifier, online identifier, IP address and location based on IP address, device identifier, browsing history, search history and information regarding interaction with an Internet website, application or advertisement. This may also include information about the browser you are using or what site you came from and what site you visit when you leave us. We may also collect information about how you interact with an advertisement.

·       Children’s Information. We may collect personal information about children in connection with camps, kids’ clubs or similar activities. This information may include the child’s name and age. This information is provided to us by parents or guardians of the children and is used to administer the camp or kids’ club, for security purposes, as required by law or as requested or directed by the parent or guardian. Children’s information is not sold or shared.

·       Precise Geolocation Information. Our mobile applications may include third-party integrations that request permission to collect precise geolocation information from you. The collection, use and disclosure of this information is governed by the third-party’s privacy policies.

Retention Criteria for Personal Information: We consider, on a case-by-case basis, a number of factors to assess how long personal information is retained. These factors include what personal information is reasonably necessary to (i) provide our products and services or administer our relationship with an individual; (ii) protect our business, employees, organization and others; (iii) fulfill our legal and regulatory obligations; and (iv) investigate and address issues which may include safety concerns, potential security incidents or policy violations.

We may disclose your personal information as described above.  In addition, we may disclose your personal data to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by us about our users and customers are among the assets transferred/

Furthermore, we may disclose your personal information where such information is necessary to comply with the law, protect our rights, or for security reasons.

Your Privacy Rights

You have the rights listed below with respect to the personal information that we maintain about you. We may take steps to verify your identity, as permitted or required under applicable law, before we process your request. Verification may include asking you to provide information about yourself that we can match against information already in our possession.

    • Notice. You can request that we disclose what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling or sharing personal information, the identities of third parties to whom we have disclosed personal information, and the specific pieces of personal information we have collected about the consumer.
    • Deletion. You can request that we delete personal information about you which we have collected from you.
    • Correction. You can request that we correct inaccurate personal information that we maintain about you.
    • Opt Out of Sale of Personal Information. You have the right to opt out of the “sale” of your personal information, as this term is defined by applicable state law. You may submit an opt-out request at this link[AC9] .
    • Opt Out of Use of Personal Information for Targeted Advertising or Profiling. You have the right to opt out of the processing of your personal data for purposes of targeted advertising or profiling in furtherance of automated decisions about you.
    • Opt Out of Sharing of Personal Information. You may have the right to opt out of sharing of personal information with third parties for cross-contextual marketing purposes. You may submit an opt-out request at this link[AC10] .
    • Right to Non-Discrimination. This means that we are prohibited from discriminating against you if you exercise your rights under applicable law.
    • Portability.  You have the right to obtain data that we have collected about you up to twice a year.  Data will be provided in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.

If we deny your rights request and you would like to appeal, you may contact us at wild-legalservices@wild.com. Please indicate that you are making a “Privacy Rights Appeal” request.

Agents that you have authorized to act on your behalf may also submit privacy requests as instructed above. The agent must also provide evidence that it has your written permission to submit a request on your behalf. If we are unable to verify the authenticity of a request, we may ask you for more information or may deny the request.

Please note that we do not knowingly sell or share the personal information of consumers under 16 years.

DNT Signals

Where technically feasible, we honor web browser Do Not Track (“DNT”) signals. 

State-Specific Privacy Rights

The law in some states may provide you with additional rights regarding our use of personal information.

Your California Rights

California law requires us to let you know how we respond to DNT signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Data about your online activities over time. Where technically feasible, we honor DNT signals.  In addition, as of January 1, 2020, you have the additional rights described in the California Addendum if you are a California resident.

7.              DATA SECURITY

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. We use encryption technology for information sent and received by us.

The safety and security of your information also depends on you. Where you have chosen a password for the use of website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our website. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our website or in your operating system.

8.              THIRD PARTY SITES

Our website may contain links to third party websites or services that are not owned or controlled by us, including, without limitation, those described below. Please be aware that we are not responsible for the privacy practices of such other websites or services. The privacy practices of these third parties, including details on the information they may collect about you, are subject to the privacy policies of these parties, which we suggest you review.

  • Social media platforms. Based on your social media privacy settings, most social media platforms analyze how you interact with us and combine it with information about other users and may share with us certain personal data about you. To the extent you provide your personal data on social media platforms, those social media providers' policies and practices apply with respect to their sites and services. We do not control such social media providers and are not responsible for how they treat your personal data.
  • Promotional sponsors. If a MVV-related promotion is run by a third party (such as the sponsor of the promotion), that third party's policies and practices may apply with respect to personal information collected through such promotion. We do not control such third parties and are not responsible for how they treat your personal data.

9.              CHILDREN UNDER THE AGE OF 13

The services made available online via webpages expressly governed by this Privacy Policy and through our website are generally not directed at nor intended for use by minors. We do not knowingly collect information from minors under the age of 13. If you are under 13, please do not use or provide any information to us online via webpages that are expressly governed by this Privacy Policy, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received information from a minor under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from a child under 13, please contact us through the Contact Information below.

10.           CHANGES TO OUR PRIVACY POLICY

We may change this Privacy Policy at any time. It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users' Personal Data, we will notify you by email to the email address we have on file for you. The date this Privacy Policy was last updated is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and periodically reviewing this Privacy Policy to check for any changes.

Privacy Addendum for California Residents

This California Privacy Addendum (the "California Addendum") supplements the information contained in the MVV’s Privacy Policy and applies solely to all fans, users, customers and others who reside in the State of California ("consumers" or "you"). We adopt this California Addendum to comply with the California Consumer Privacy Act of 2018 and its implementing regulations, as they may be amended or superseded from time to time (the "CCPA"), and any terms defined in the CCPA have the same meaning when used in this California Addendum.

1.     COLLECTION OF PERSONAL INFORMATION

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("personal information"). The type of personal information we collect may vary depending on your relationship with us. For this reason, we may collect, and over the prior 12 months have collected, the following categories of personal information from consumers:

A.   Identifiers, such as name, contact information (e.g., postal address, telephone number, email address), IP address, driver's license or other government-issued ID number, single sign-on login credentials to the MVV website, social media handle, and other similar identifiers.

B.    Personal information as defined in the California Customer Records law, such as name, contact information, driver's license or other government-issued ID number, bank account number, credit or debit card number, or other financial information.

C.        Characteristics of protected classifications under California or federal law, such as age and sex.

D.   Commercial information, such as details of transactions, ticket purchases, or other transactions with us.

E.    Geolocation data, such as your real-time location (if you have opted-in to sharing your location through the website).

F.    Internet or other electronic network activity information, such as information regarding a consumer's interaction with our services available online via webpages expressly governed by our Privacy Policy.

G.   Audio, electronic, visual, or similar information, such as audio, video or call recordings created in connection with our business activities.

H.   Professional or employment-related information, such as the name of your employer, the industry in which you work and your job title.  If you are employed by us, we map collect additional information such as performance evaluations, employment applications, and personal information needed to implement payroll and benefit plans. 

I.      Inferences drawn from any of the other personal information listed above, to understand your preferences.

Personal information does not include publicly available information from government records, deidentified or aggregated consumer information, or other information as set forth under the CCPA.

2.     SOURCES OF PERSONAL INFORMATION

We have obtained the categories of personal information listed above from the same categories of sources described in the Notice At Collection section of our Privacy Policy.

3.     USE OF PERSONAL INFORMATION

We use or disclose the personal information we collect and, over the past 12 months have used or disclosed the personal information we have collected for one or more of the following business or commercial purposes listed in the Notice At Collection section of our Privacy Policy.

MVV will not collect additional categories of personal information or use the personal information we collected for additional purposes without providing you notice.

4.  SHARING OF PERSONAL INFORMATION

Disclosures of Personal Information for a Business Purpose

In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose to our affiliated entities: identifiers; personal information as defined in the California Customer Records law; characteristics of protected classifications under California or federal law; commercial information; geolocation data; professional or employment-related information; and inference data.

In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose to our sponsors: identifiers and personal information as defined in the California Customer Records law.

Sales of Personal Information

In the preceding 12 months, we have not sold consumers' personal information.

5.     YOUR RIGHTS AND CHOICES

The CCPA provides consumers with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection, use, disclosure, and sale of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

      • The categories of personal information we collected about you.
      • The categories of sources from which the personal information was collected.
      • Our business or commercial purpose for collecting or selling the personal information.
      • The categories of third parties with whom we share the personal information.
      • The specific pieces of personal information we collected about you.
      • If we sold or disclosed your personal information for a business or commercial purpose, two separate lists identifying: (i) the categories of personal information disclosed and the categories of third parties to whom the personal information was disclosed, and (ii) the categories of personal information sold, and the categories of third parties to whom the personal information was sold.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we have collected or maintained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act.
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf (an "Authorized Agent"), may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. We are not obligated to provide information to you in response to your verifiable consumer request for access or portability more than twice in a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an Authorized Agent.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We are unable to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. With few exceptions, we will only review and fulfill a request from your Authorized Agent if (i) you grant the Authorized Agent written permission to make a request on your behalf, (ii) you or the Authorized Agent provides us notice of that written permission, and (iii) we are able to verify your identity in connection with that notice and the request. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Verifying Your Identity

Before completing your request to exercise the below, we will verify that the request came from you by comparing the identifying information provided by you in your request with any personal information we maintain about you at that time. For all requests, we will need the consumer's (i) name, (ii) email address, and (iii) telephone number.

To protect the privacy and security of your personal information, we may request additional information from you to help us verify your identity and process your request. This information may include your driver's license or other government-issued identification number. We may also contact you to ask you for further information in relation to your request to speed up our response. You may also be asked to complete and provide a signed declaration under penalty of perjury that you are the consumer who is the subject of the request in certain circumstances. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

6.     NON-DISCRIMINATION

You have a right not to receive discriminatory treatment by us for exercising your rights under the CCPA. Unless permitted by the CCPA:

  • You will not be denied goods or services.
  • You will not be charged different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • You will not be provided a different level or quality of goods or services.
  • You will not receive suggestions that you could obtain a different price or rate for goods or services or a different level or quality of goods or services.

7.     CHANGES TO OUR CALIFORNIA ADDENDUM

We reserve the right to amend this California Addendum from time to time. When we make changes to this California Addendum, we will post the revised California Addendum on this page with a new "Last Updated" date.
