RULES AND REGULATIONS
- INTRODUCTION
(a) The Columbus Fury, in conjunction with Nationwide, is pleased to announce its 2025 SHEroes Among Us Program (“Program”), where eligible persons may be considered for a chance to be recognized as a winner ("Honoree") (as defined below). (b) Beginning December 20, 2024, at 9:00 am Eastern Standard Time (“ET”) (“Submission Commencement Date”), persons nominating eligible and potential Honorees (see paragraphs 2 and 3 below) may submit a Program Entry Form (“Program Form”) via the Columbus Fury website (the “Website”) to nominate a person for a chance to be selected as a SHEroes Among Us Honoree. (as defined herein).
- ELIGIBILITY REQUIREMENTS FOR PARTICIPANTS
(a) No purchase necessary. This Program is open to individuals who, at the start of the Program, meet the Conditions of Entry in paragraph 3 below (herein defined as “eligible Honoree”), except those persons who are also:
Employees, representatives, and agents of the Columbus Fury or Nationwide, or any of their respective subsidiaries, related, affiliated or parent companies, their respective advertising and/or promotional agencies and/or other sponsors; and any other person or entity connected with the production, administration or judging of the Program; or Immediate family (spouses, parents, siblings, and children) and household members of such employees, representatives, and agents as described above.
(b) By entering this Program, eligible Honorees hereby irrevocably agree to comply with these Official Program Rules (the “Rules”) and agree to abide by all decisions and/or results of all voting/judging conducted in the Program, which shall be final and binding on all eligible Honorees in all matters relating to the Program. There shall be no right of appeal. To be awarded a Prize, an eligible Honoree must comply with all provisions of these Rules.
- CONDITIONS OF ENTRY FOR ELIGIBLE HONOREES
(a) The following requirements are conditions of entry and participation for every eligible Honoree in the Program:
Eligible Honorees must demonstrate a commitment to making a difference in their community, and whose work, project, or volunteerism serves as a model in their community, including but not limited to:
Demonstrate exceptional commitment to their efforts; Make an outstanding contribution to the improvement of their community or support of a registered 501(c)(3); Exemplify the spirit of community service Receive no personal financial compensation for their volunteer activities; Perform the majority of their community service within central Ohio Eligible Honorees must be nominated by a third party; Service, organization, or actions must be currently active; Service or at least a portion of the service must have occurred within the past 12 months; Self-nominations will not be accepted; Eligible Honorees must not have a criminal record or any pending criminal charges; Previous Honorees are ineligible to be selected in any subsequent Programs; Eligible Participants shall be required to provide proof of eligibility upon request by the Columbus Fury or Nationwide.
- ONLINE SUBMISSIONS
(a) Between December 20, 2024, at 9:00 am ET and April 1, 2025, at 10:00 pm ET (“Submission Entry Period”), persons may nominate eligible Honorees for the Program by submitting:
An accepted Honoree's Declaration and Release Form (to be accepted by the parent or legal guardian of the eligible Participant if the eligible Participant is below the age of 18 years as of the Submission Commencement Date);
A completed Program Submission Form which must contain the following four (4) elements:
The nominee’s full details, including their full name, age, and birthdate;
A full description of their project (including any articles/links if available);
A description of their impact
(b) The Online Submission is MANDATORY for an eligible Honoree to enter the Program. However, the Columbus Fury and Nationwide and its associates and/or affiliates assume no liability whatsoever with respect to any failure to receive or review any Online Submission(s).
(c) Only ONE (1) Online Submission may be submitted per eligible Honoree. Entries received shall be deemed to be submitted by the authorized account holder of the email address associated with the entry. For the purpose of these Rules, the “authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The Columbus Fury and/or Nationwide may require the eligible Honoree or person nominating the eligible Honoree, as applicable, to provide proof that she is the authorized account holder if required.
- PROGRAM END DATE
The closing date for Online Submissions is April 1, 2025, at 10:00 pm ET (the “Submission End Date”).
- SELECTION PROCESS
(a) Online Submissions will be reviewed by the Columbus Fury SHEroes Among Us, presented by Nationwide Program preliminary and final judging panels ("the Selection Committee”). The members of these panels shall be selected by the Columbus Fury and Nationwide at its absolute discretion.
All submissions will be vetted by the Selection Committee to ensure compliance with the Program Rules.
The Selection Committee will select each Honoree in their sole discretion, based on criteria including the impact of their project or cause in their community, volunteerism, ongoing commitment to the betterment of their community, and otherwise.
Each selected Honoree will be contacted by the Selection Committee.
(b) THE SELECTION COMMITTEE IN ITS SOLE DISCRETION SHALL SELECT THE CHOSEN HONOREES. THE DECISION OF THE SELECTION COMMITTEE SHALL BE FINAL AND BINDING WITH NO RIGHT OF APPEAL. In the event of any dispute regarding the interpretation of these Rules, the decision or interpretation of the Selection Committee shall prevail.
- AWARD
The AWARD comprises of:
Ten (10) tickets to the match in which Honoree is awarded
An engraved award (plaque)
An autographed Columbus Fury jersey
Recognition on the Columbus Fury website and social media channels - AWARD CONDITIONS
(a) The Columbus Fury and Nationwide and/or sponsors reserve the right to substitute any portion of any of the Award, in whole or in part, in the event that all or any component of the Award is unavailable.
(c) The selected Honoree (and or her parent(s) or legal guardian(s), if applicable) shall be responsible for her own ground transportation that may be applicable and/or related to the Award element.
(d) Following confirmation as an Honoree in accordance with the Rules, the potential Honoree will be given instructions and a deadline as to how they must claim the Award. Potential Honorees who fail either to claim the Award or to inform of their inability to claim the Award before the deadline, as instructed, may be required to forfeit the Award and another eligible Honoree may be selected at the Selection Committee's sole discretion.
(e) The selected Honoree agrees to participate in any promotion, publicity, photographs, video, or other coverage of the presentation of the Award.
- PRIZE SUBSTITUTION / REMOVAL
The Columbus Fury and Nationwide reserve the right in their sole discretion to remove any portion of the Award from the Program or to substitute any component or components thereof, of equal or greater value than the whole or any part of the award, at any time.
- CONSENT FOR USE OF PERSONAL INFORMATION
Subject to paragraph 12(g) below, when an Honoree is entered into the Program and voluntarily, or her parent(s) or legal guardian(s) voluntarily, as applicable, provides her personal information, including, but not limited to, email address, first name, last name, age, city, postal code, home phone number, cell phone number, and email address (collectively, the "Honoree Information”), she agrees and consents to the collection and use of the Honoree Information in conducting and administering the Program, including but not limited to media and internal usage.
- MISCELLANEOUS
(a) Online Submissions received by the Selection Committee will not be returned, and no correspondence will be entered into except with eligible Honorees whose Online Submissions are selected, or eligible Honorees who request a copy of these Rules by emailing:partnerships@columbusfury.com with the subject line “2025 SHEroes Among Us (Rules)”.
(b) The Columbus Fury and Nationwide shall not be responsible for (i) incorrect or inaccurate entry information that may affect a person’s ability to participate in the Program or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, omission, or any combination thereof, and entries that fail to fully comply with the Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Releases; (iv) injury or damage to entrants’ computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Program or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the Honoree's participation in the Program or receipt or use or misuse of any prize, including any related travel and the use of entries by Producer; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner. The eligible Participant hereby agrees to irrevocably release the Releasees (as defined herein) from and against any claim or cause of action arising out of any technical errors related to computers, servers, providers, printers, or telephone or network lines and errors in the administration of the Program or the method of processing entries.
(c) The Columbus Fury and Nationwide reserves the right, in its sole discretion and without notice, to cancel, suspend or modify the Program, in whole or in part (including but not limited to the awarding of any prizes), for any reason whatsoever, including but not limited to, (a) acts of God; (b) flood, fire, earthquake, tsunami, epidemics, pandemics, including, but not limited to, the novel COVID-19 pandemic, or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the start date of the Program; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other disturbances; (i) shortage of adequate power or transportation facilities;
(e) release of liability information.....
(f) Honorees irrevocably grant to the Columbus Fury, Nationwide and its affiliates, legal representatives, assigns, agents and licensees, a non-exclusive, royalty-free, worldwide, sub-licensable, unconditional, perpetual and transferable right and license to reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse the eligible Honoree's name, age, photo and likeness, voice, address (city only), biographical material, prize information and Online Submission, including, but not limited, to photographic images, video images, portraits, interviews or other materials relating to the eligible Honoree and arising out of their participation in the Program (with or without using their name), in any manner or medium throughout the world for any purpose (including advertising, publicity and promotional purposes), provided that their name, voice and likeness shall not be used as an endorsement of any product or service other than the Columbus Fury, the Program in and for the Program or its sponsors, without limitation, and without additional review, compensation, consideration, consent or approval from the eligible Honoree or any other party. To avoid doubt, the Honoree retains all ownership rights and copyrights in and to the Online Submission in relation to the Program.
(g) The Columbus Fury and Nationwide reserve the right, at any time, to disqualify and immediately remove any eligible Honoree from the Program who, in their sole discretion, has breached any of the Terms and Conditions of the Honoree’s Declaration and Release and/or these Rules, including, without limitation, if any representation or warranty made herein is found to be false or incorrect or misleading in a material respect, by omission or otherwise. In such event, the individual shall be replaced with the next best Submission(s), as determined by the Selection Committee at its sole discretion. The Columbus Fury, in agreement with Nationwide, reserves the right to terminate or withdraw this Program at any time, for any reason, without any prior notice.
(h) NO COMMUNICATION OR CORRESPONDENCE WILL BE EXCHANGED WITH ANY NOMINEE EXCEPT THE ONE SELECTED AS THE HONOREE.
